In these terms and conditions 'The Seller' means Nine Yards Ireland and 'The Buyer' means the purchaser of goods from 'The Seller' under these terms and conditions.
Trade only Nine Yards Ireland operates exclusively as a wholesaler, it does not sell directly to the General Public. It does not deal with Consumer Sales. All sales are to the Trade. By placing an order with Savvy & Shine Limited you are confirming that you are not a Consumer for the purposes of the Consumer Credit legislation and for the Purposes of Sale of Goods legislation and that you are in business and purchasing the goods for the purpose of that business and not for personal use. All products sold on this website are intended for those qualified in the hairdressing or beauty trade and are for sale on a trade only basis. Customers should be qualified to use the products sold on this website. Goods are sold on the understanding that they will be used for their intended purpose. No responsibility will be accepted by The Seller, for trained or untrained personnel without qualified supervision using or mis-using equipment supplied by The Seller. If you are a business customer, it is your responsibility to ensure that you are insured for products that you are using and we reserve the right to ask you for proof of professional status.

We will not be liable, whether directly or indirectly, for the privacy practices or content of such websites nor for any damage, loss or offence caused or alleged to be caused in connection with, the use of or reliance on any such advertising, content, products, materials or services available on such external websites or resources.
When you place an order to purchase an item from Nine Yards Ireland, we will send you an email confirming receipt of your order and containing the details of your order. Your order represents an offer to purchase a product which is accepted by us when we despatch that product to you. That acceptance will be complete at the time we despatch the product to you. Any products on the same order which are not despatched, do not form part of that contract.
All orders are subject to acceptance and availability. If the goods ordered are not available, you will be notified by email (or by other means if no email address has been provided) and you will have the option either to wait until the item is available from stock or to cancel your order.
Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time. You acknowledge that any automated acknowledgment of your order which you may receive from us shall not amount to our acceptance of your offer to purchase goods or services advertised on the Website. The conclusion of a contract between you and us will take place when we (i) debit your credit, debit card or PayPal account or (ii) dispatch the goods to you or commence the services, whichever is the later.
We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be liable for any loss you may suffer if a third party procures unauthorised access to any data provided by you when accessing or ordering from the Website. The products sold on the Website are not for resale or distribution. We reserve the right to cancel orders and/or suspend accounts where we believe products are being ordered in breach of this provision.
You will assume the risk for the products once they have been delivered to the delivery address which you specified when ordering the products. We accept no liability where you provide an incorrect delivery address or where you fail to collect the products from the delivery address which you specified.
After 40 days a surcharge of 4% of the gross amount will be levied on a daily basis.
Your Online Account
If you use this website, you will be responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You must ensure that the password is kept confidential. If you believe that your password has become known to anyone else, you must inform us immediately.
Nine Yards Ireland reserves the right to refuse access to the website, terminate accounts, or cancel orders at our discretion. If we cancel an order you will not be charged.

We will acknowledge all complaints within five working days. We will advise the shopper of our process and keep them involved throughout the process.
This offer applies only to qualifying items listed in the Multibuy area of this Website. Where any goods are returned (except for an exchange where products are faulty/defective), we are entitled to either require the return of all goods delivered as part of that Multibuy offer at your cost or charge you for the goods retained by you at the full price quoted on this site.
All products are subject to stock availability. Stock availability is shown on the website, however if we have insufficient stock to fulfill the order, we will notify you by email at the address given by you in your registration form. Stock is allocated on a first come first served basis once your order reaches our main server. The Seller does not guarantee the availability of any item based on stock figures shown.
Shortages & Damages
Goods must be inspected on delivery and all claims for shortages or damages must be reported to The Seller within 24 hours of receipt of goods.
The Seller's policy is to despatch goods within 24 hours of receiving an order, however this can vary subject to stock availability. Times quoted are in good faith, but shall not be binding. The Seller can accept no responsibility for transport delays causing late delivery. Some furniture orders may take up to 6-8 weeks for delivery, or up to 14 weeks for special order items. Extra handling charge may be incurred for re-despatched parcels.
Next Day Delivery
Orders must be received before 1pm (UK time) between Monday to Thursday, to be delivered the next working day. Next day delivery only applies to items that are in stock. Does not apply to items that are sent direct from our supplier, or large or heavy items. The Seller can accept no responsibility for transport delays causing late delivery. Next day delivery is only available to mainland UK and Ireland.
£4.95 plus VAT is the standard delivery charge for most parts of Ireland. Special delivery charges will be quoted on request. Orders placed online over £100, excluding VAT, to most parts of Ireland have free delivery. This excludes any large or heavy items. Free delivery over £100 does not apply to orders where a promotional discount has been applied.
We welcome orders from anywhere in the world. Please remember carriage will vary on destination and weight of parcel. Carriage will be calculated at the end of your order. Price available on application. Full payment will be required by BACS or electronic transfer prior to despatch. Delivery of overseas orders may be affected due to political conflicts, such as war, civil unrest, martial law, etc.
When ordering goods from Nine Yards Ireland for delivery outside the United Kingdom you may be subject to import duties and taxes which are levied once the goods reach the specified destination. Any additional charges for Customs clearance must be paid by you; Nine Yards Ireland has no control over these charges and cannot predict what they may be. If you are ordering goods from outside the United Kingdom, it is your responsibility to comply with all the laws and regulations in the country in which you are receiving the goods.
Prior to despatch, non standard items such as furniture/special order items, cannot be cancelled. Cancellation after despatch cannot be accepted.
If you do cancel a contract then:

- You must retain possession of the goods or services and ensure that the goods or services are kept in the same condition as they were when they were delivered until such time as the goods or services are either collected by us or delivered back to us by you
- We will notify you of when we wish to collect the goods or services. The goods and services will be collected by us within 28 days of our receiving your cancellation notice and we will charge the cost of collecting the goods or services, and will deduct this from any sum owed by us to you. Alternatively, you can return the goods or services to us by contacting a customer service operator on 0044 2894 467762 (between the hours of 9.00am to 6.00pm) who will be able to provide you with address details

Price And Payments
Prices and special offers are correct at the time of goods being displayed on the website but are subject to alteration without prior notice. Prices are exclusive of VAT at the ruling rates and delivery costs. VAT is not charged on educational books. It is possible that some of the products in our catalogue may be mis-priced. If a product's correct price is lower than the stated price on the website, we will charge the lower amount and send you the product. If a
product ́s correct price is higher than the price stated on the website, we will, at our discretion, either contact you.
Eligibility To Purchase
To be eligible to purchase goods on this Website and lawfully enter into and form contracts on this Website under English law you must:

The content of the Website is protected by copyright, trade marks, database and other intellectual property rights and you acknowledge that the material and content supplied as part of the Website shall remain with us or our licensors.
You may retrieve and display the content of the Website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Website.
No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.
If goods have been ordered in error or are not as expected, please contact our Customer Services Department on 0044 2894 467762 to request a returns authorisation number. If goods have been ordered in error, the Buyer must pay for the return postage. The relevant reference number must be quoted on accompanying documentation. Goods must be returned within 7 days of receipt, unused, in perfect condition and sent back in its original packaging. Carriage for any alternative items is to be paid for by The Buyer. The Seller accepts no responsibility for items lost in transit. It is recommended that a receipt of posting is obtained and it is the Buyers responsibility to ensure adequate insurance is purchased to cover the items being returned. Refunds on large/heavy items will be subject to a minimum 10% handling charge. Collections for unsuitable items will be subject to a minimum 10% handling charge. Collection of goods with a value of £100.00 or less and parcels returned to sender will be subject to a minimum charge of £6.00 per parcel. Porcelain basins and all furniture which has been made to special order cannot be returned. Due to strict hygiene regulations, the Seller cannot accept returns of items such as scissors, clippers, razors which have been used. (This list is not exhaustive). Goods returned damaged due to poor packaging will not entitle The Buyer to a full credit/refund. Your Statutory Rights are not affected.
Please note any items that are sent direct from the manufacturer are non returnable if they are unsuitable. This does not affect your statutory rights. For more information please contact Customer Services. Please be aware, postage will not be refunded for items returned as unsuitable.
Should you wish to return an item for any reasons, please notify us within 48 hours of receipt of your order of any part that is unsatisfactory. In order to arrange a return, please contact us and inform our customer service team of your order number, the item you are returning and the reason for the return. We will then reply with a unique returns authorisation number and the address you need to send the item to.
You'll need to package the item securely and include:
- Your order number
- The returns authorisation number
- Whether a replacement or refund is needed
- The reason why you are returning the item.
Goods returned should be in their original condition and packaging in which they arrived, along with a copy of the invoice or packing slip. Once received items will be checked and refunds on goods and postage arranged where suitable. We cannot issue refunds on simply unwanted goods due to the perishable nature of goods on sale. Refunds/exchanges will only be offered on items that are faulty, and were clearly so at the time at which they were dispatched.
All offers are subject to stock availability. The Seller reserves the right to restrict or refuse any order for application of credit at any time. The Seller takes special care to show correct sizes and specifications and such descriptions, whilst given as a guide, in good faith, are subject to alteration by The Seller without notice. All colours are as near as can be displayed on a computer monitor.
In order to maintain the highest standards of customer service and to help with the training of new staff, we sometimes monitor and record calls.

All items are guaranteed according to the individual manufacturer's warranty. Any faulty items which are still under the manufacturer's warranty must be reported and sent back for inspection before a refund or replacement can be issued. All glass items are specifically excluded from this guarantee.
Retention Of Title Clause
The risk in all goods passes to The Buyer upon delivery but title in the goods remains vested in The Seller and shall only pass from The Seller to The Buyer upon full payment being made of all sums (due on whatsoever account or grounds) to The Seller.
We will retain the legal ownership of the goods until full payment has been made by you and such payment has been received by us. Legal ownership of the goods will immediately revert to us if we refund any such payment to you.
The Buyer agrees, prior to the payment of the whole price of the goods, The Seller or appointed agents may enter The Buyers premises to collect such goods should The Seller request. Prior to such payment, the Buyer shall keep the goods separate and identifiable for the purpose and return the goods to The Seller should The Seller request.
